Terms & Conditions — The Literary Agent's Read

1. Who you are contracting with

The Literary Agent's Read (the "Service") is operated by Sarah Ulicny ("we", "us", "our"). By using the Service, you agree to these Terms.

2. The Service

The Service provides AI-generated literary assessments of manuscripts, queries, and writing samples. Assessments are produced by large language models, not by human literary agents or editors. Assessments are delivered instantly upon submission.

We offer two purchase options:

Single Assessment ($9.99): a one-time purchase that adds one assessment credit to your account. Credits do not expire while your account is active.
Monthly Pass ($19.99/month): a recurring subscription that includes up to 15 assessments per calendar billing month. The included assessment count resets at the start of each billing period and does not roll over. Unused assessments are forfeited at renewal.

Important: AI-generated assessments are for informational and educational purposes only. They are not a guarantee of publication, agent representation, or commercial success. They are not professional editorial, legal, or business advice. You are responsible for verifying anything you act upon.

2a. Monthly Pass — auto-renewal and cancellation

The Monthly Pass is a recurring subscription that automatically renews each month at $19.99 (plus any applicable taxes) until you cancel. By subscribing, you authorise us and our payment processor (Stripe) to charge your payment method on each renewal date.

You can cancel at any time from your Account page via the "Manage subscription" link, which opens Stripe's billing portal. Cancellation takes effect at the end of the current billing period — you keep access until then, and you will not be charged again.

We may change subscription pricing or included assessment limits with reasonable advance notice (at least 30 days) by email or in-product notice. Changes apply from your next renewal; you may cancel before they take effect.

3. Your account

You must provide accurate information and keep your account credentials confidential. You are responsible for activity under your account. You must be of legal age to form a binding contract.

4. Acceptable use

You agree not to: use the Service unlawfully; submit content that infringes third-party rights; attempt to reverse engineer, scrape, or interfere with the Service; submit malware or probe for vulnerabilities; misuse the AI to generate disallowed content (e.g. illegal, hateful, or harassing material).

5. Your content

You retain all ownership of manuscripts and content you submit. You grant us a limited license to process your content solely to deliver the assessment. We do not claim rights in your work and do not use it to train third-party models.

6. AI outputs

Assessments are generated by AI and may contain inaccuracies. You are responsible for how you use the outputs. Outputs should not be relied upon as professional advice. We may filter, refuse, or moderate outputs at our discretion.

7. Payments and refunds

Payments are processed by Stripe. By purchasing, you agree to Stripe's consumer terms. Refunds are described in our Refund Policy.

8. Our IP

The Service, including its software, design, and branding, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service. You may not resell or redistribute the Service.

9. Service level

We do not guarantee the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time.

10. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated policy violations.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Our aggregate liability is capped at the fees you paid to us in the prior 12 months. We are not liable for indirect, consequential, or special damages, including lost profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where law prohibits such exclusion.

12. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.

13. Changes

We may update these Terms. Continued use of the Service after changes constitutes acceptance.
